Licence AgreementFollowing is the licence agreement that you are required to accept before using the Kyscope.
PLEASE READ THIS SOFTWARE LICENCE AGREEMENT ('LICENCE') CAREFULLY.
1. Licence
1(a). Kyscope 2.2 software ('Kyscope') includes: a linked set of Microsoft® Excel spreadsheets with formulae
underlying operational cells of the spreadsheets;
Visual Basic® macros (in source code) that underpin the operation of different parts of the spreadsheets;
and, electronic manuals in the form of a User's Guide in Microsoft® Help format.
(Microsoft® and Visual Basic® are registered trade marks of Microsoft Corporation in the United States and/or
other countries.)
1(b). Kyscope is the subject of this non-exclusive, non-transferable Licence.
1(c). The developer of Kyscope, Wayne Mayo ('Developer'), is sub-licensing Kyscope to you for the purpose ('Purpose')
of investigating policy settings relating to the taxing of income from investments.
1(d). The Licence commences after you indicate your acceptance of the agreement, consent is subsequently given to the
Developer to sub-license Kyscope to you by the Commonwealth of Australia ('Commonwealth'), represented by and acting
through the Department of the Treasury, Langton Cresent Parkes ACT 2600, and a copy of Kyscope is delivered to your postal
address.
2. Permitted Uses and Restrictions
2(a). You may use Kyscope under the terms and conditions set out in this Licence.
2(b). This Licence allows the installation and use Kyscope on computers for the Purpose as required by you and, if
applicable, your officers, employees, agents and subcontractors (and your students, if you are an educational institution).
2(c). You may not sub-license, sell, lease or distribute Kyscope in whole or in part.
2(d). You may release into the public arena with or without acknowledgement of source results from Kyscope's spreadsheets
produced by running Kyscope but, if such results are produced as a result of changes being made to Kyscope's spreadsheet
formulae or macros, any form of acknowledgement of the use of Kyscope must not be made.
3. Intellectual Property
3(a). The Commonwealth owns the entire intellectual property in Kyscope, except for the Kyscope registered trade mark.
3(b). The Developer has a permanent, irrevocable, non-exclusive licence (including the right of sublicence) to use, reproduce,
adapt and exploit Kyscope.
3(c). Kyscope is protected by copyright and other intellectual property laws and by international treaties.
3(d). You may not take any action to jeopardise, limit or interfere in any manner with the intellectual property rights relating
to Kyscope.
3(e). You will take all reasonable measures to protect Kyscope from unauthorised use, reproduction, or distribution.
3(f). Your possession, installation or use of Kyscope does not transfer to you any title to the intellectual property
in Kyscope.
4. Implied Warranties
4(a). In line with trade practices legislation, the Developer warrants that Kyscope will enable you to investigate policy settings relating to the taxing of income from investments consistent
with the Kyscope Brochure, Examples,
Slide Show and Features provided on this
Kyscope website.
4(b). You accept that all responsibility and obligation to install and use Kyscope rests solely with you.
5. Disclaimer of Warranty on Kyscope
5(a). You accept that Kyscope has been provided to you solely for the Purpose and that
the Developer cannot accept any responsibility for the use or operation of Kyscope.
5(b). The Developer does not warrant that Kyscope will provide any function not reflected in the
Kyscope Brochure, Examples,
Slide Show and Features provided on this
Kyscope website.
5(c). The Developer gives no warranty that Kyscope is free of fault or virus or spyware, despite the
Developer's taking reasonable steps to avoid these.
5(d). The Developer makes no express warranties other than those set out in this Licence.
6. Limitation of Liability
6(a). You acknowledge that the Developer is not liable to you for any incidental, indirect, special, consequential or
economic loss or damage (including loss of profits or opportunities and exemplary and punitive damages) howsoever
caused whether due to negligence or otherwise arising from your use of or reliance on Kyscope.
6(b). You acknowledge that the Developer is not required to provide any training or other support in relation to
Kyscope.
7. Term and Termination
Your rights to use Kyscope will terminate automatically without notice from the Developer if you fail to
comply with any term of this Licence.
8. Applicable Law
This Licence is covered by the laws of the Australian Capital Territory, Australia.
9. Dispute Resolution
If any dispute arises over this Licence you or the Developer may not commence any court proceedings until notice has been given to the other party of the nature of the dispute and both you and the Developer have endeavoured in good faith to resolve the dispute using informal dispute resolution techniques (such as mediation, expert evaluation or similar agreed techniques).
